Embattled Ovie Omo-Agege resumes at Senate's plenary

As the battle between Ovie Omo-Agege and some of his colleagues at the Senate continues to linger, the senator representing a district in Delta state, showed up at the National Assembly on Wednesday, May 16, for the day's plenary.

Alex Izinyon (SAN) had while objecting to the application said he thought the Senate will withdraw the application because it said it will obey the judgment of the Court.

As early as 9:30 a.m., journalists stationed their cameras around the entrance of the Senate chamber to catch on tape the resumption of the senator.

Omo-Agege had, however, attended plenary on April 18.

Mr Omo-Agege was also not in his office.

His suspension was based on his comment that amendment to section 25 of the Electoral Act, 2010 (as amended), bordering on reordering of elections sequence was targeted at President Muhammadu Buhari.

The court noted that it was wrong for the Senate Committee on Ethics, Privileges and Public Petitions to suspend Omo-Agege for going to court after he had apologised over his comments against the Senate.

The committee said the punishment was imperative because the senator took the issue to court after it was referred to the committee.

THEWILL recalls that the high court had in its judgment, held that the reason the Senate adduced for suspending Omo-Agege was unconstitutional.

Justice Dimgba noted that, while the application said it sought a stay of the judgment in which all the plaintiff's reliefs were granted, the May 10 judgment did not grant reliefs one to seven of the plaintiff, but merely made consequential order under the omnibus prayer.

The President of the Senate, Bukola Saraki, had on Tuesday last week inaugurated the ad hoc committee, noting that there were reports that those who attacked the Senate were led by a serving senator.

Had the application succeeded on Wednesday, it could have formed a basis to again shut the door of the Senate against the embattled senator until the Court of Appeal ruled otherwise. But he also advised the lawmakers to withdraw their appeal of the judgement.

Omo-Agege was suspended by the Senate for 90 days but a court subsequently nullified the action, directing that he should be allowed to resume.

He said, "However, the Executive branch of the Federal Government is called upon to emulate the good example of the Senate by complying with all valid and subsisting judgments of all courts in Nigeria".

Also, a former National Security Adviser, Col. Sambo Dasuki, has been in the detention of the same agency since December 2015 despite a later judgment of the Court of Justice of the Economic Community of West African States, ordering his release.
