Chase Bishop, 29, is being held in the Downtown Detention Center on suspicion of second-degree assault, according to inmate records on the Denver Sheriff Department website.

Bishop, who had left the city shortly after the incident, turned himself into Denver Police on Tuesday before he was formally charged.

The bullet Bishop fired ended up striking the leg of 24-year-old Tom Reddington, a fellow patron of Mile High Spirits who was seated at a picnic table nearby.

Footage of the incident shows Mr Bishop dancing with a crowd around him when he suddenly thrusts himself backward onto his hands.

In court on Wednesday, the judge gave Bishop permission to travel back to Washington, D.C., where he lives. He then put the gun back in his trousers and walked away with his hands up.

Retired FBI supervisory special agent James A. Gagliano wrote for CNN last week that he understood the need for a young agent to blow off steam.

"I heard a loud bang and I thought some idiot set off a firecracker", Reddington told ABC News. I'm still thinking it's a firework.

The firearm went off when the agent picked it up.
