Deputy White House Press Secretary Raj Shah said that Brett Kavanaugh ran up thousands of dollars in debt buying baseball tickets.
Schumer is claiming Trump chose Kavanaugh because he is an advocate for strong executive powers and will protect Trump from Robert Mueller. In that event, a few Democrats will probably break ranks and support the nominee in order to enhance their re-election prospects.
Kavanaugh was hired as a law clerk for Justice Anthony Kennedy in 1993 and was even sworn in by Kennedy as a judge on the D.C. Court of Appeals in 2003.
There's a record number of women raising their hands for public office in recent months, putting a focus on female empowerment in an era of #MeToo. Elizabeth Warren tweeted yesterday, following up on her initial Monday night tweet: "Trump wants to put Brett Kavanaugh on the SCOTUS -but he can't do it without a Senate majority".
Fallon tweeted back: "We already know the answers to these questions, Tim Kaine".
As Kavanaugh asserted that the majority's decision represented "a radical extension of the Supreme Court's abortion jurisprudence", he added, "It is undoubtedly the case that many Americans - including many Justices and judges - disagree with one or another aspect of the Supreme Court's abortion jurisprudence". But Kavanaugh is, I believe, a careful and judicious guy and probably has been all along.
The reason, according to the White House: baseball.
Kavanaugh disappointed social conservatives in a 2017 case involving a pregnant teenage immigrant in federal custody who wanted an abortion. Democrats say they will fight to prevent the high court from becoming too conservative. Susan Collins (Maine) and Lisa Murkowski (Alaska) in an effort to overcome the GOP's slim Senate majority.
Conservative groups, meanwhile, have praised Kavanaugh.
The Affordable Care Act is "wildly popular and necessary in the reddest of states", said Senate Democratic Leader Chuck Schumer of NY, in an interview Tuesday on MSNBC's "Morning Joe".
Kavanaugh's writings already have been cited in Supreme Court rulings, as in a 2013 decision preventing certain U.S. lawsuits against foreign corporations alleged to be responsible for human-rights abuses overseas and a 2015 decision stopping the Environmental Protection Agency from regulating mercury emissions from coal-fired plants without taking account of costs.
Donnelly is one of the most vulnerable red-state Democrats, so he may not be able to afford separating himself from Trump on such a consequential vote. The president has faced allegations of sexual harassment and remains under investigation for obstruction of justice in the Russian Federation election meddling investigation.
The report took a more liberal approach to the definition of obstruction of justice, but after seeing the toll that investigations can take on presidents, Kavanaugh rescinded his approach and now argues that presidents should be exempt from criminal prosecutions and civil suits.
Unlike some of the other justices, Kavanaugh has worked more than two decades in the public sector and has not built wealth as a private lawyer.
In 2011, the dispute over the President Barack Obama-sponsored Affordable Care Act, came before Kavanaugh's court.
That line of thinking would be useful to Trump, who is unlikely to face impeachment so long as Republicans control Congress.
