Microsoft joins Open Invention Network and open sources its patent portfolio

Report: Microsoft making patents royalty-free for Android OEMs Microsoft just open-sourced 60,000 of its patents

Microsoft announced Wednesday, October 10 (October 11 Manila time) it had joined the Open Invention Network (OIN), an open-source patent group that works to protect Linux from patent suits.

In spite of this, the use of patents to extract royalties was one of the major sticking points within the open source community, used as evidence that Microsoft was not genuine in its commitment to open source principles. Despite that, Microsoft has made more than 60,000 of its patents open source.

Make a clear, unambiguous statement that it has ceased all patent infringement claims on the use of Linux in Android.

OIN's chief mission is to protect Linux from patent lawsuits by having members like Google, RedHat, IBM, and now, Microsoft. Microsoft will add almost 60,000 patents to OIN, vastly enlarging its existing pool of 1,300 global patents. Enterprise cloud computing depends heavily on Linux and other open-source technologies, and any type of patent dispute involving open-source technology would send shock waves through the system. As a result, Android vendors were pressured to ink deals, forcing them to pay royalties to Microsoft. In 2001, Microsoft's previous CEO Steve Ballmer also famously derided Linux as a "cancer" on intellectual property. In 2016, the company even became a member of the Linux Foundation.

We know Microsoft's decision to join OIN may be viewed as surprising to some; it is no secret that there has been friction in the past between Microsoft and the open source community over the issue of patents.

The Verge added some things, like Windows desktop and desktop application code, will not be going open-source, though that's to be expected. Previously, OIN only had ownership of 1,300 global patents.
