Third-party factories agreed to pay Qualcomm "billions of dollars per year" for the right to use their patented technology in iPhones.

In a preliminary ruling, the U.S. District Court for the Southern District of California ruled that Qualcomm owed Apple almost $1 billion in rebate payments that were part of the business cooperation agreement of the two companies. "The stakes in that case are higher: the dollar amounts are staggering, and it goes to the core of Qualcomm's business model". Today's ruling is unrelated to the patent fight that both companies are embroiled in, but pertains to the matter of patent royalty rebates. The damages date back to July 6, 2017, when Qualcomm filed its lawsuit, and covers technology used in the iPhone 7, iPhone 7 Plus, iPhone 8, iPhone 8 Plus and iPhone X. Qualcomm counters that its patents covering the way phones connect to wireless networks are essential to today's smartphones, and it wants recognition - and royalties - for that. US courts have been unwilling to order outright sales bans and favor financial remedies.

The verdict was part of Qualcomm's worldwide litigation leveled against Apple over technologies used to boost iPhone performance, which has already produced injunctions prohibiting the sale of certain iPhone models in Germany and China.

While the damages awarded Friday aren't significant to either company, from Qualcomm's perspective, valuing just three of its more than 10,000 patents at $1.41 per phone shows the overall worth of its inventions.

Don Rosenberg, executive vice president and general counsel of Qualcomm, told Reuters in a statement, "Although the Court today did not view Apple's conduct as a breach of Apple's promises to Qualcomm in the 2013 Business Cooperation and Patent Agreement, the exposure of Apple's role in these events is a welcome development".
