The man who got into a gun battle with the California Highway Patrol in Riverside, killing Officer Andre Moye and injuring two other CHP officers, had a lengthy criminal record.

Police on Tuesday released the name of a man who they say killed a highway patrol officer before being fatally wounded in a Southern California shootout.

The Highway Patrol officer and the suspect were rushed to nearby hospitals and declared dead after the shootout, police said. Investigators were still gathering evidence, Tuesday morning.

His stepmother, Debbie Howard, told reporters that Moye loved his job. CHP Inland Division Chief Bill Dance said it's not clear whether Moye asked a dispatcher to seek any additional information on Luther, 49, who was convicted of attempted murder in 1994 and also had convictions for assault, domestic violence, unlawful possession of a firearm and battery.

Dennis Luther tells KABC-TV that 49-year-old Aaron Luther of Beaumont had been depressed and was having physical and marital troubles before his vehicle was stopped near a freeway in Riverside, east of Los Angeles.

One of them received major injuries and is in critical condition.

Other officers soon arrived at the scene, as The Times reported - and witnesses later described a scene of chaos.
